The Law and Purpose

The LSSICE has been created as a result of the extraordinary expansion in telecommunication networks, in particular the Internet as a vehicle for transmitting and exchanging information.
The Internet and new technologies create uncertainties for individuals concerned about the use of their private information. It has been necessary for governments to establish a suitable legal framework to generate the necessary confidence for users.

Having a website or sending marketing messages involves adopting a series of measures described in the LSSICE and the LOPD (Data Protection) laws.

Companies and professionals

Companies and professionals who have their own website and domain, who use e-mailing for business purposes, to send marketing information to their clients or possible clients.

Individuals or companies

Individuals or companies who act as intermediaries in providing services for others on the Internet (e.g. IT services and internet service providers).

When companies clearly comply with these laws, customers gain confidence in their services.

Penalties

Fines for non-compliance can be up to 30,000€ for minor offences, ranging up to 600,000€ for very serious infractions.
